General Terms and Conditions of Atlantis Water Park Portal
In the use of this website or the atlantis-vodnomesto.si portal (hereinafter: "Portal") certain rules apply. These rules are described in these General Terms and Conditions of the Atlantis Water Park Portal and any amendments thereto (hereinafter: "General Terms and Conditions") and govern the functioning of the Portal, the terms, conditions, limitations and manner of use of the Portal. They also govern the relationship between the Portal users or visitors (hereinafter: "Users") on the one hand, and the company BTC, d. d., Ameriška ulica 2, 1000 Ljubljana, registration number: 5068681000, VAT ID: SI51367971 (hereinafter: "BTC"), on the other hand.
These General Terms and Conditions refer to the use of the Portal as a whole and its individual parts and subsites, unless otherwise specified in these General Terms and Conditions for individual parts or subsites.
In order to provide Users with the best and most enjoyable experience using the Portal, its contents, information, visual and audio materials and features related to the aforementioned are constantly amended, added, removed or adapted. BTC therefore reserves the right to change any part of the Portal, including adding or removing individual content or sections, without any prior notice of the Users. The User is welcome to visit and browse the Portal and use the functions and services offered by the Portal at any time, but always compliant with the General Terms and Conditions.
Portal Content
The content of the Portal includes information, articles and content on a wide range of offers, services, events, news related to Atlantis Water Park and the option of receiving newsletters.
The following sections of these General Terms and Conditions relate solely to the operation of the individual subsites or to the operation of specific functionalities of the Portal, which are defined individually below.
Receiving Newsletters
On the Portal, the User has the option to subscribe to newsletters. The User can subscribe to receive newsletters to be informed about novelties, offers and events related to Atlantis Water Park. The User can choose whether to receive news about pools, wellness or both.
When subscribing to the newsletter, the User must provide certain personal data (name and surname, e-mail address). BTC will process the User's personal data in accordance with the Privacy Policy, and the User agrees to the processing of personal data in accordance with the Privacy Policy by providing personal data at the time of subscribing to the newsletter.
Subscribing to receive newsletters on behalf of another person is not permitted. In case of reasonable suspicion of abuse by third parties, the User is obliged to notify BTC immediately. BTC is not responsible for any misuse of data by third, unauthorised parties.
Portal Use
The User is obliged to use the Portal exclusively for personal and non-commercial purposes. Any misuse of the Portal is prohibited.
During the use of the Portal, the User is obliged to:
· Refrain from any action that would cause damage to the Portal, its software and hardware, or to BTC, BTC's external contractors, as well as to all other Portal Users, Providers and third parties, or that could cause damage or any other inconvenience, such as transfer of viruses, prevention of access to the Portal, etc., and to comply with the General Terms and Conditions and the applicable regulations and instructions of BTC, and to refrain from actions that are inherently obscene, inappropriate or otherwise morally unacceptable, which would constitute an insult, humiliation, threat, hate speech or discrimination, or incite racial, political or religious intolerance.
· Use the Portal for personal and non-commercial use and on their sole responsibility.
· Respect the protection of personal data of other Users.
The User may not use the Portal in any manner other than as permitted by these General Terms and Conditions, including, but not limited to (i) prohibiting any dissemination, sharing, reproduction, modification, transmission, sale, broadcast, recording of content in which third parties have rights; (ii) any other infringement of the rights of third parties; (iii) collecting data for inclusion in a database, (iv) using data for resale, (v) copying and using catalogues and price lists, or (vi) any other use that does not constitute personal and non-commercial use, except to the extent that such use is permitted with the express prior written permission of BTC. Notwithstanding the foregoing, the User is permitted to distribute Content on the Portal by citing the Portal as the source of the Content and simultaneously actively linking to the Portal.
In case of non-compliance with the above provisions or any other breach, BTC has the right to seek, by using legal remedies, the cessation of the breach, the removal of the consequences of the breach and the recovery of any damages and costs, including legal fees, incurred in connection therewith.
In case of reasonable suspicion of abuse, BTC reserves the right to restrict or deny the User access to the Portal, restrict or deny the use of certain functionalities of the Portal or deny the possibility to register.
Intellectual Property Rights
All content, data, information and other materials published on the Portal, including but not limited to text, images, visual and audio material, video content, software, graphics, trademarks, service marks and other content published on the Portal, are protected by intellectual property rights and are either the property of BTC or BTC is the holder of the rights to use them for the purpose of displaying or advertising on the Portal. Any further distribution, reproduction, copying, modification or any other use thereof without the express prior written consent of the owner is prohibited.
Nothing included in this Portal or the General Terms and Conditions shall be construed as granting any licence or right to use any intellectual property rights without the prior written permission of BTC or the third-party owner of the intellectual property rights.
Disclaimer
BTC is not responsible for the accuracy and completeness of the information, text, visual and audio materials, video, software, graphics, other content and related services available on the Portal.
BTC shall not be liable to Users for any unavailability or inaccessibility of the Portal or data and information on the Portal or for any interruptions in access, use or operation of the Portal due to technical or other reasons. In case of any such issues, BTC will strive to rectify them as soon as possible. BTC reserves the right, for technical or other reasons, to restrict or completely disable access to the Portal for a limited or indefinite period of time or to otherwise suspend the operation of the Portal. BTC strives to provide quality services and operation of the Portal, free of any viruses or abuse. However, BTC assumes no liability for any computer viruses, any issues, inoperability or malfunction of the User's hardware or software due to the visit or use of the Portal, or for any other damages resulting from the use of the Portal, except in cases and to the extent that the exclusion of liability due to the mandatory provisions of the applicable regulations in the territory of the Republic of Slovenia is not possible.
BTC is committed to ensuring the safety and confidentiality of data. BTC shall not be held liable for any loss of data or hacking of the Portal or User data.
Users access and use the Portal, including its functionalities, on their sole responsibility. BTC shall not be liable for any damages, whether direct or indirect, incurred for the User or any third party as a result of access to or use of the Portal or its functionalities.
The Portal may also contain links to third-party websites (including Providers' websites), which are not operated by BTC. BTC does not control third-party websites and is not responsible for the accessibility and content of such websites.
Final Provisions
These General Terms and Conditions govern and constitute the User's relationship with BTC. Therefore, it is important that the User reads, becomes familiar with and understands these General Terms and Conditions. By accessing or using the Portal and its functionalities, the User agrees to be bound by these General Terms and Conditions and to comply with them. If the User does not agree with the General Terms and Conditions, including the Privacy Policy, the User must stop using the Portal.
BTC regularly keeps the General Terms and Conditions up to date and reserves the right to amend the provisions of these General Terms and Conditions at any time without prior notice, and will post any changes to the General Terms and Conditions on this Portal. The amended General Terms and Conditions shall be effective from the moment they are published on the Portal. The User shall be deemed to have accepted the changes to the General Terms and Conditions if they continue to use the Portal after the changes have been published.
In case of any dispute between the parties concerning or related to the Portal and/or its use, the dispute shall be settled amicably. Otherwise, the parties agree that the dispute shall be settled by a competent court with jurisdiction in Ljubljana, subject to and in accordance with the Slovenian law.

The General Terms and Conditions are published and enters into force on 21. 1. 2025.
Privacy Policy of Atlantis Water Park Portal
At BTC, d. d., Ameriška ulica 2, 1000 Ljubljana, we are aware of the importance of the protection of personal data, which is why we are always striving to ensure the protection of personal data and the safe processing of personal data.
BTC respects the trust the User shows by providing their personal data. Therefore, BTC cares about the User's privacy and undertakes to protect the personal data obtained in accordance with this Privacy Policy, the applicable legislation governing the protection of personal data and the User's expressed wishes.
Below, we provide important information regarding the processing of your personal data, including your rights arising therefrom.
What Does the Privacy Policy Cover
This Privacy Policy governs the protection of your privacy as visitors or users (hereinafter: "User") of the website or portal atlantis-vodnomesto.si (hereinafter: "Portal") and informs Users about the collection of personal data on the Portal, the purposes for which the Portal uses or processes Users' personal data, the basis for the processing of personal data, to whom the personal data is provided, and the rights of Users in relation to personal data.
In compliance with the Privacy Policy, the controller of personal data is BTC, d. d., Ameriška ulica 2, 1000 Ljubljana, registration number: 5068681000, VAT ID: SI51367971 (hereinafter: "BTC").

This Privacy Policy applies only in relation to BTC and does not apply to the websites of other parties that may be listed on the Portal or accessible from the Portal (e.g., as websites of Providers in accordance with the General Terms and Conditions, since the websites of such Providers are subject to the privacy rules published on their websites or on their business premises).
Collected Personal Data
Depending on the specific purpose and the personal data that the User wishes to provide, BTC may collect the following personal data from the User:
· e-mail address,
· location,
· channel through which the consent was provided,
· history, time and manner of changes to the personal data,
· data about the computer or any other device used by the User to access the Portal,
· information about the visit or use of the Portal and the User’s online behaviour.
Purpose and Legal Basis for Processing of Personal Data
BTC collects and processes the personal data of Users who provide BTC with their personal data for different purposes and, depending on these purposes, on different legal bases:
Consent
Sending newsletters
If the User subscribes to the newsletter, the following personal data, which they provide at the time of registration on the Portal, will be processed: e-mail address, location, channel through which the consent was provided, time and manner of changes to the personal data.
The personal data will be processed for the purpose of receiving newsletters informing the User about the Portal's novelties and offers, as well as about news, offers and low-cost products or services.
For this purpose, the data will be kept until the consent is withdrawn.
Portal Operation
The personal data obtained during the User’s use of the Portal, in particular the data collected by means of cookies, is used to provide, improve and support the operation of the Portal and the online services and functionalities related to the Portal, including the determination of the number of Users, the identification of user trends, calculations and statistics on user-access patterns and the improvement of the Portal services. For this purpose, the data is retained until the consent to the processing of personal data for this purpose is withdrawn. For more information in this respect, please refer to the section "Cookies".
In order to ensure the operation of the Portal, BTC also collects certain data relating to the use of the Portal. The collection of this data is automatic and the User will not be asked to provide consent for the collection of this data. The User may withdraw consent to the processing of personal data at any time by:
· clicking "Unsubscribe" in the e-mail received, where possible;
· replying to the received e-mail, where possible, and writing "Unsubscribe" in the subject or content of the e-mail or by sending "Unsubscribe" to the e-mail address info@atlantis-vodnomesto.si.
Withdrawal of consent shall not affect the lawfulness of data processing prior to the withdrawal.
Legitimate interests
BTC will also process Users' personal data on the basis of legitimate interests pursued by BTC or a third party in cases where such interests are not overridden by the interests or fundamental rights and freedoms of the Users, in particular in the cases set out below.
Log Files
Each time a User visits the Portal, the web server automatically stores log files of the web server, including, but not limited to the IP number, browser version, time of visit. BTC collects this information in order to ensure network and information security, i.e. to enable the detection and prevention of unauthorised access that may compromise the availability, integrity and confidentiality of stored or transferred personal data and the security of related services accessible through these networks and systems.
The data is stored for up to 60 days after the visit to the Portal.
Protection of Business Operations
BTC will also process Users’ personal data for the purpose of legitimate interests of preventing abuse, fraud and protecting business operations, in cases where this is permitted by law, and for the purpose of asserting or defending claims in judicial, administrative, criminal or other proceedings.
Legal Basis
BTC will also process Users' personal data on the basis of regulations applicable in the Republic of Slovenia, which are for BTC binding.
Safety of Personal Data
BTC ensures the protection of personal data in accordance with all applicable laws and has therefore taken a number of technical and organisational measures to ensure the safety and protection of personal data and to ensure the confidentiality and integrity of personal data and to prevent unauthorised or unlawful processing, including any accidental loss, destruction or damage. BTC strives to ensure the complete safety of the use of the Portal and its functionalities. However, given the nature of the internet, it is necessary to point out that it is not possible to completely protect data against access by third parties and that, in exceptional cases, unauthorised intrusion by third parties may occur.
The User is also responsible for the protection of their personal data by ensuring the security of their username, password and other data and by using appropriate software (antivirus protection) on their computer.
Transfer of Personal Data to Third Parties
BTC will share or transfer personal data to third parties – contractual partners as processors of personal data for the purpose of the operation of the Portal and the implementation of its functionalities.
BTC may also transfer personal data to social network providers where the Portal offers the possibility of using plug-ins of these social networks, in case the User chooses to register an account on a social network, whereby data on the User's activities on the Portal may also be made available to these social networks on the basis of privacy policies (which the User agrees to when signing up for that social network). If the User does not wish to share data in this way, it is necessary to unsubscribe from social networks. The providers of these plug-ins are as follows:

BTC will also transfer Users' personal data to the competent state authorities in case of a request by such authority or for the purpose of other legal proceedings.
User Rights Related to Personal Data
With regard to the use of their personal data, the User has the right to:
· Have access to personal data or to information, which means that the User may request from BTC information about what personal data BTC holds about the User and other related information, and BTC will send the User a confirmation of the information requested.
· A correction, in case the User's information held by BTC is incorrect or incomplete.
· A deletion, where BTC will delete the User's personal data at the User's request due to withdrawal of consent, termination of an otherwise valid basis for processing the personal data or fulfilment of the legal grounds for deletion.
· Request a restriction of processing, in the event of the occurrence of a case provided for by the applicable regulations which requires such restriction.
· Data portability, whereby the User will receive the personal data relating to them in a structured, commonly used and machine-readable format and may transfer it to another controller, subject to the conditions provided for by the applicable regulations.
· File an opposition with BTC or file a formal opposition with the Information Commissioner.
In addition to the aforementioned, all such requests addressed to BTC, including withdrawal of consent to the processing of personal data, may be sent by the User via e-mail to vop@btc.si or by regular mail to BTC, d. d., Ameriška ulica 2, Ljubljana.
Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal.
Final provisions
BTC reserves the right to change the provisions of this Privacy Policy at any time without prior notice in order to update them in accordance with applicable law or to optimise them. All changes are published on the Portal. In this respect, it is recommended that the User checks the Privacy Policy from time to time. The User shall be deemed to have accepted the changes to the Privacy Policy if they continue to use the Portal after the changes have been published.
